FCS auctions Terms and Conditions- FCS auctions (FCS Auction Services Pty Ltd) provide and operate auction software (owned by Bidsonline Pty Ltd) in order for the Selling Agent to conduct online auctions via the internet. The Selling Agent and Auctioneer act as the agent for the Vendor.
- INTERNET DIFICULTIES. The Internet is prone to slow downs and outages and so FCS auctions and Bidsonline wish to warn users that at times, it may not be possible to bid over the Internet at an auction. Bidders are advised to bid as early as possible and to use the maximum bid facility and have the system bid for you. Internet speed of Satellite Broadband may not be adequate for the final bidding period of an auction.
- AUCTION INFORMATION. Intending bidders need to be aware of the information about the auction available from the FCS auctions web site, in particular where a buyer’s premium is payable, what taxes are payable, the methods of payment and times of inspection and collection. FCS auctions do not pack or freight goods. Collection is the responsibility of the Purchaser.
- FAULTS AND MISDESCRIPTION RULE. All lots are sold as they are, and the sale shall not be invalidated by reason of any defect or faults in any of the lots by reason of, any of the lots being incorrectly described in the catalogue or elsewhere, or missing parts or quantities, and neither the sellers nor the Auctioneer shall pay compensation in respect of any faults or errors of description, parts or quantities.
- AUCTIONEERS DISCRETION. The auctioneer has total discretion in choosing to accept a bid and may, without giving any reason, refuse to accept the bidding of any person or persons. A bid, once accepted, cannot be withdrawn. The Auctioneer acts as the agent for the Vendor. Some lots may have a reserve price. If a reserve price is not achieved during the auction, the lot will be passed in and the Agent will contact the highest bidder after the auction.
- PAYMENT AND COLLECTION. Please read the conditions of each sale on FCS auctions website as described by the Agent. Cleared payment must be received into the Agent’s account before goods will be released to the buyer. Goods are at the risk of the Purchaser from the fall of the hammer. Collection is at a time nominated by the Agent. Failing to make payment or collect goods within 48 hours, the Agent reserves the right to resell the goods and the buyers bidding rights may be suspended from future auctions.
- REGISTRATION. Registration only needs to be completed once to permit the bidder to participate in any online auctions conducted by FCS auctions. All bidders are required to register well before the auction. By accepting all terms and conditions you warrant that you are at least 18 years of age and able to enter a legally binding contract, that you will be financially responsible for your use of the FCS auction system and that you will be responsible for any usage by minors or any other party of these auction services under your name or account. By accepting these terms and conditions you give permission to FCS auctions and Bidsonline to use the supplied address and other details for verification purposes. A bidder who defaults any of the terms and conditions may have their bidding rights suspended.
- Read the Full Terms and Conditions carefully before using the auction system. By “agreeing to the terms and conditions” by ticking the check box, you agree to all these terms and conditions. If you do not agree to all these terms and conditions, do not continue with registration.
